It’s determined by several factors. If your departure or arrival airport is Danish, you can file your claim with the Danish courts.
If your departure airport isn’t Danish, but the airline has a Danish office, your case can be filed in Denmark. In all other cases, the case must be filed in the country where you take off or land.
There’s an exception though! If you’ve booked your trip as a package holiday, Denmark will still be the right place to file the case.
This is unique to flight cases, as all other consumer cases can be filed in Denmark if the purchase was made online through advertising.
For example: Purchases made online, and in this context, we’re thinking of Travellink, the case can be filed in Denmark, in the jurisdiction where the person owed money resides.
